GroupWire Agreement and terms
1) This Terms of Use Agreement (“Agreement” or “Terms of Use”) is made by and between GroupWire and you (“you,” “your” or “User”). This Agreement contains the terms and conditions that govern your use of this Website & the GroupWire IOS, Android apps.
2) Information resource «GroupWire» not a mass media, the Administration of a resource does not edit the information posted and is not responsible for its content.
3) A user posting information on the resource «GroupWire», independently represents and protects its interests arising in connection with the placement of the specified information, in relations with third parties.
The following describes the rights, privileges & responsibilities of users and the administration.
It describes the rules for user-generated content.
a) BY ACCESSING OR ATTEMPTING TO INTERACT WITH ANY PART OF THIS WEBSITE, OR OTHER GroupWire SOFTWARE, SERVICES, WEBSITES OR ANY OF GroupWire LICENSEES’ SERVICES (COLLECTIVELY “SERVICES”), YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS WEBSITE.
b) GroupWire RESERVES THE RIGHT, FROM TIME TO TIME, WITH OR WITHOUT NOTICE TO YOU, TO MAKE CHANGES TO THIS AGREEMENT IN GroupWire’S SOLE DISCRETION. CONTINUED USE OF ANY PART OF THIS WEBSITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. THE MOST CURRENT VERSION OF THIS AGREEMENT, WHICH SUPERSEDES ALL PREVIOUS VERSIONS, CAN BE REVIEWED BY CLICKING ON THE TERMS OF USE HYPERLINK LOCATED AT THE BOTTOM OF EVERY PAGE ON THIS WEBSITE.
4) About GroupWire
a) GroupWire is designed for communication.
b) GroupWire is not responsible for any decisions and actions that you take, based on what you post and read on GroupWire.
c) GroupWire is not intended for trading, so any transactions that you take on yourself are your responsibility. You Should Not use GroupWire to sell and buy any products or services.
d) GroupWire is developed and maintained for legitimate use only. You Should Not use GroupWire to violate the law; violate the confidentiality; intellectual property of any person or organization.
5) Accounts on GroupWire
a) To use the application, you must create an account that includes the phone number (login), and name to constitute ("your account").
b) Users while using GroupWire are prohibited from:
i) Register as a user on behalf of another person («false account») or to register a group (Association) of individuals or legal person as the User, it is possible to register in the name and on behalf of another natural person or legal entity subject to obtaining the necessary authority in the manner and form prescribed by the legislation of your country.
ii) Confusing the users with your identity using the username and password of another registered User.
iii) Distort information about yourself, your relationships with other persons or organizations.
iv) Download, store, publish, distribute, make available or otherwise use any information that’s: Hateful, threatening, defamatory, insulting, demeaning, dis-honoring, and undignifying, or damaging business reputation, or violates the privacy of other Users or third parties.
v) Violates the rights of minors.
vi) There are vulgar or obscene, contain foul language, pornographic images, and texts or scenes of a sexual nature involving minors.
vii) Contains material that promotes bullying, child abuse, sexual exploitation, and human/child trafficking.
viii) Contains scenes of violence or inhumane treatment of animals.
ix) Contains a description of the means and methods of suicide, or any instigation to commit suicide.
x) Promotes and/or promote racial, religious, or ethnic hatred or enmity, fascism, or the ideology of racial superiority.
xi) Contains extremist materials.
xii) Contains advertising or describes the appeal of narcotic substances, including "digital drugs" (audio files affecting the human brain through binaural beats), information on the distribution of drugs, their recipes, and tips on usage.
xiii) Is fraudulent in nature.
xiv) Illegally download, store, publish, distribute, and provide access or otherwise use the intellectual property of other Users and third parties.
xv) User is solely responsible for any information posted on GroupWire, according to other Users, as well as any interactions with other Users, at their own risk.
c) In case of disagreement with these rules or their updates, the User must stop using it and inform GroupWire in the prescribed manner.
6) Information we collect, how we handle and use it.
a) GroupWire must receive or collect some information to operate, provide, improve, understand, customize, support, and market our Services, including when you install, access, or use our Services. The types of information we receive and collect depend on how you use our Services.
b) We require certain information to deliver our Services and without this, we will not be able to provide our Services to you. For example, you must provide your mobile phone number to create an account to use our Services. Our Services have optional features which, if used by you, require us to collect additional information to provide such features. You will be notified of such collection, as appropriate.
c) If you choose not to provide the information needed to use a feature, you will be unable to use the feature.
7) Your Account Information.
a) You must provide your mobile phone number and basic information (including a profile name of your choice) to create a GroupWire account. If you don’t provide us with this information, you will not be able to create an account to use our Services. You may add other information to your account, such as a profile picture and "about" information which is optional.
8) Your Network.
a) You may use the contact upload feature and with your consent provide us, if permitted by applicable laws, with the phone numbers in your address book on a regular basis, including those of users of our Services and your other contacts.
b) This feature is for your convenience to be able to add members (Existing GroupWire users) to your network from your contact list. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified by us.
c) With your consent, you may create, join, or get requested to be added to groups. Such groups and lists get associated with your account information.
d) You choose a name for each group you create. You may provide a group profile picture or description (Optional).
9) Customer Support & Other Communications.
a) When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any other information you deem helpful, and how to contact you (e.g., an email address). For example, you may send us an email with information relating to app performance or other issues.
10) Automatically collected information
a) Usage And Log Information.
i) We collect information about your activity on our Services, like service-related, diagnostic, and performance information. This includes information about your activity (including how you use our Services, your Services settings, how you interact with others using our Services (including when you interact with a business), and the time, frequency, and duration of your activities and interactions), log files, and diagnostic, crash, website, and performance logs and reports.
ii) This also includes information about when you registered to use our Services; the features you use like our messaging, calling, Status, groups (including group name, group picture, group description), payments or business features; profile photo, "about" information; whether you are online, when you last used our Services (your "last seen"); and when you last updated your "about" information.
b) Device And Connection Information.
i) We collect device and connection-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, battery level, signal strength, app version, browser information, mobile network, connection information (including phone number, mobile operator, or ISP), language and time zone, IP address, device operations information, and identifiers.
11) Obligations of the User at GroupWire:
a) Comply with the provisions of the current legislation of your country, these rules, and other special documents of the Administration of GroupWire.
b) Provide accurate, complete, and timely data, follow their actualization.
c) Inform GroupWire about unauthorized access to the personal page and / or unauthorized access and / or use of the password and the login of the User.
d) Do not place in groups information and objects (including links), which may violate the rights and interests of other persons.
e) Before placing the information and objects (including but not limited to images of other persons, strange texts of different contents, audio recordings, and videos) review the legality of their distribution.
12) Other User Mechanisms
a) You can block the accounts of other users or violators (spam, insults, pornography, copyright infringement, etc.)
b) You can remove other users from your network
c) You can remove/eject participants from groups
d) You may leave groups
e) You may delete your account completely
f) You may Report/tell us about the users-violators (spam, insults, pornography, copyright infringement and others)
13) Content on GroupWire
a) GroupWire gives users the right to self-generate content, thus:
i) You agree that you have the right to post everything that you post and that your user content does not infringe copyrights, trademarks, trade secrets, or any other personal or property rights of any other party.
ii) Administration does not bear any responsibility for the content provided by users.
iii) Administration has the right to remove user-generated content without warning.
iv) Administration moderates all user content and can delete user content if the content violates resource rules.
v) You can flag objectionable content so that the administration can act (delete the content if the content violates the resource rules)
vi) Administration will act against objectionable content reports within 24 hours, removing the content and ejecting user who provided the infringing content
14) GroupWire Administration
a) GroupWire administration provides the technical possibility of its use by Users and is not involved in shaping the content of personal pages of the Users and does not control and is not responsible for the actions or omission of any person regarding the use of GroupWire or the formation and use of the content of Users' personal pages on GroupWire.
b) Administration reserves the right at any time to change the GroupWire design, content, list of services, change or add scripts, software, and other objects used or stored on GroupWire, and any server applications at any time with or without notice.
c) GroupWire administration does not carry out preliminary moderation or censorship of information. However, GroupWire may take action to protect the rights and interests of persons and ensure compliance with the requirements of the legislation of your country only after the appeal to the Administration of GroupWire in the prescribed manner.
d) Removing the User's personal page automatically means the removal of all information contained in it, as well as all information entered by the User at registration on GroupWire. After the removal of a personal page, the User loses access to GroupWire.
e) GroupWire administration ensures the functioning and performance of the site, APIs, apps and will promptly restore its functioning in case of technical failures and interruptions. GroupWire is not responsible for the temporary disruptions and interruptions in the work of the users and the resulting loss of information. GroupWire is not responsible for any damage to your computer or any other person, mobile devices, any other equipment, or software caused by or associated with downloading materials from GroupWire or any links on GroupWire.
f) GroupWire has a right to dispose statistical information related to the operation of GroupWire, as well as the User's information to provide targeted display advertising information to different audiences and Users of GroupWire. For the purposes of the organization functionality and GroupWire maintenance and enforcement of these Rules, GroupWire Administration has the technical ability to access the user's personal page, which is implemented only in cases, stipulated by these Rules.
15) Limitation of liability of the Administration of GroupWire
a) THE SITE AND ITS SERVICES, INCLUDING ALL SCRIPTS, APPLICATIONS, CONTENT, AND DESIGN OF THIS SITE ARE PROVIDED «AS IS». THE ADMINISTRATION REFUSES TO GUARANTEE THAT THE SITE OR SERVICES MAY OR MAY NOT BE SUITED FOR PARTICULAR PURPOSES. THE ADMINISTRATION CAN NOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM THE USE OF THE WEBSITE AND / OR SERVICES.
b)BY USING THE SITE, THE USER AGREES THAT, BY DOWNLOADING FROM THE SITE OR ANY MATERIALS AT YOUR OWN RISK AND ARE SOLELY RESPONSIBLE FOR ANY CONSEQUENCES OF USING THESE MATERIALS, INCLUDING ANY DAMAGE IT MAY CAUSE TO YOUR COMPUTER OR ANY THIRD PARTY FOR ANY LOSS OF DATA OR OTHER HARM.
c) UNDER NO CIRCUMSTANCES THE ADMINISTRATION OF THE SITE OR ITS REPRESENTATIVES BE LIABLE TO USER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA, DAMAGE TO THE HONOR, DIGNITY OR BUSINESS REPUTATION IN CONNECTION WITH USING THE SITE, CONTENT OR OTHER MATERIALS TO WHICH YOU OR OTHERS HAVE ACCESS THROUGH THE SITE, EVEN IF THE ADMINISTRATION WARNED OR POINTED OUT THE POSSIBILITY OF SUCH DAMAGES.
